
Florida Woman Sentenced to 1 Year for Killing Terminally Ill Husband

A woman who fatally shot her terminally ill husband in 2023 at his request has been sentenced to almost one year in jail and 12 years of probation. Ellen Gilland reportedly locked herself and her husband in a hospital room and warned she would shoot anyone who tried to come in.

The shooting occurred at AdventHealth Daytona Beach in Florida. Ellen Gilland, 78, shot her husband, Jerry Gilland, in his Daytona Beach hospital room on Jan. 21, 2023. About three weeks before the shooting, Gilland and her husband, 77, had made a murder-suicide pact. Jerry had reportedly told his wife that he wanted to be shot when his health started to get worse.
“I held the gun behind his ear. I pulled it away and asked him if he was sure,” Gilland testified in court, according to KBTX. "He raised his hand and placed it on my arm and pushed the gun to his head. There was a loud bang and he was gone.” Gilland also recalled attempting to shoot herself, but she was unable to do so.
Once arrested and charged, she pleaded no contest to the charges against her.
Threatened Others
Ellen Gilland reportedly locked herself in the hospital room with her husband for 3 1/2 hours. She said she would shoot anyone who tried to enter. During the incident, she pointed her gun at a security officer and a nurse, and even fired her gun toward police officers, according to The Daytona Beach News-Journal.

A Sympathetic Judge
The judge in the case appeared to feel sympathy for Gilland and said she believed her husband was truly suicidal. She told Gilland she was sentencing her to time because of the pain and trauma the incident caused others. As part of her sentence, Gilland must write apology letters to the staff members she threatened that day, as well as to the police, according to The Daytona Beach News-Journal. She is also required to do community service every month for as long as she is physically able.

Attorney Pleased With Outcome
Although Matthew Ferry, Gilland’s attorney, had hoped she would only get probation, he was pleased with the outcome, especially because the 78-year-old woman could have faced up to 10 years in prison.
“We’re very thankful, again, to Judge Weston, and showing compassion to Miss Gilland and taking into consideration all the mitigation that we provided,” Ferry said, as reported by KBTX.

While she was sentenced to nearly one year in jail and 12 years of probation, the judge showed sympathy for her, understanding the emotional strain she was under.
